DUI Leaving Good Ol Days Cumming Ga

If you have been charged with DUI Leaving Good Ol' Days in Cumming, Georgia, read this article for information on where to go from here and protecting your rights and defending your case.

Appealing Your License Suspension

On any DUI arrest in Georgia, you have 10 days to appeal the suspension of your driver's license. This is especially important if the cop has marked you as a "refusal" DUI, as a refusal carries a 12 month suspension without any limited permit. Even if you took tests and they were over the legal limit, you should appeal the suspension of your license, as it gives us a chance to speak to the officer about your case before it reaches court, and possibly have a hearing that helps your DUI case.

We always appeal the suspension of our clients' driver licenses as part of our initial fee to defend your case. Talk to us about this today!

Field Sobriety Testing

Field sobriety tests are used by officers in Cumming, Georgia, to make a decision on whether to arrest a suspect for DUI. Chances are, if you took field test, you would at least remember some of the things you had to do. Following the cop's pen, walking a line, standing on a leg, and blowing on an alcohol test beside your car are all very common field sobriety tests used. Try to recall, and write down, how you feel like you did on these tests and any information you think may help us when attacking your case.

At Zeliff | Watson, both of our attorneys have not only been trained to cops' standards on field testing, but have even taught fellow lawyers on how to score and use these tests to their clients' advantage.

Blood & Breath Tests

Under Georgia implied consent law, a cop who arrests you for DUI must ask you to take a blood, breath, or other chemical test. While rarely cops forego or forget about this test, 99% of cases have a request for a blood or breath test. This testing is what makes DUIs so much different from other cases. Attacking the science, and knowing exactly how the testing and procedures work is essential to DUI defense.

Both Mr. Zeliff and Mr. Watson have extensive classroom and courtroom experience in attacking all types of scientific tests in DUI cases. Whether you took a breath test on the old Intoxilyzer 5000 (no longer in service after 1/1/16), the newer 9000, or a blood test at Northside Forsyth or another hospital, we have the knowledge and skill to defend your DUI case.

Cumming Municipal Court

If you have been arrested leaving Good Ol' Days, or other establishments in the City of Cumming, your case will likely be heard in the Cumming Municipal Court. If Cumming PD arrested you, it will definitely start there. If you happened to be stopped in city limits by a Forsyth County deputy, then it's possible that your case goes directly to the county's State Court.

Cumming has court on Fridays, and we will attend this court date with you and negotiate with the prosecutor's office when challenging your case. Our staff will obtain all evidence from the city, including police reports, videos, and any scientific evidence, so we have your case ready to negotiate when court does come up. In the event we cannot work out a resolution to your case in Cumming's court, we can always transfer the case to Forsyth County. We will discuss these various decisions in your first consultation and throughout your case.
