If you have been arrested in the Greater Atlanta area, and charged with Driving Under the Influence, please contact our office to begin the defense process immediately. Under Georgia law, even first time offenders are subject to jail time, driver's license suspension, mandatory probation, as well as a host of other court-ordered terms and conditions. On a DUI refusal case, the stakes are even higher, with a possible one year license suspension, and no work or hardship driving permit available. You only have 10 business days after your arrest to appeal your license suspension- call us today to get your appeal letter sent, certified mail, to the Georgia Department of Driver Services.


  1. Gather all paperwork you received from your arrest. This should include Uniform Traffic Citations, bonding paperwork, and possibly a test slip from any alcohol test you might have submitted to. Keep these vital documents in a safe place like a folder devoted to your defense.
  2. Write, in narrative form, the events leading up to, and including your DUI arrest. Be specific and write down as much information as possible about everything you remember. This will aid in your defense down the road.
  3. Contact us to analyze your case and discuss your defenses with you. Depending on the particular court, arresting officer, and other circumstances, our approach to defending your case will vary. We offer a standard questionnaire for our clients to fill out that we find very helpful in gathering relevant information.
  4. Make sure your " 10 day letter" has been sent to the Dept. of Driver Services. If the 10 day deadline is missed, for any reason, DDS is unforgiving and will not make an exception- your license will be suspended on the 31 st day following your arrest. If you elect to have our firm submit this letter, we send the letter certified mail, fax it, and give you confirmation that it has been completed.
  5. Mark your calendar with your first court date, written on the bottom of your citations (usually yellow carbon-copies). This court date in Atlanta and surrounding areas is usually your arraignment date where you enter a plea to your charges. Make sure you have an attorney retained well in advance of this date, as it is advantageous to have time for your attorney to gather all of the available evidence in your case (videos, police reports, officer information, Intoxilyzer information, etc.)
