Field Sobriety Tests in Georgia

Arrested? Hire a Proven Cumming DUI Attorney

If you've been pulled over under the suspicion of a DUI, it's likely that the officer will ask that you agree to a field sobriety test. While the officer may not share this important bit of information, these tests are voluntary – under no circumstances are you legally obligated to agree to a field sobriety test if you are not in police custody.

At Zeliff | Watson, we have more than 16 years of criminal defense experience, and have secured favorable outcomes on behalf of many clients facing DUI charges. When you come to our firm, you can trust that we will build the best defense possible to safeguard your future.

We proudly represent clients throughout Forsyth County. Call Zeliff | Watson today at (770) 676-1340.

Should I refuse to take a field sobriety test?

Although you may be encouraged to take a field sobriety test in an effort to show the officer that you're innocent, these tests are designed to prove guilt. Agreeing to a field sobriety test does not necessarily guarantee an escape from arrest – there is always the possibility that the officer places you under arrest if they find one small error in your sobriety test.

If you are pulled over, you should do the following:

  • Provide the officer with your license, registration, and proof of insurance
  • Step out of the car, but only if you've been asked to
  • Avoid engaging in conversation – you do not have to answer questions such as, "have you been drinking?"
