What is Georgia's "Less Safe" law?

If you refused to take a breath test or even if you took the test and blew under the legal limit, you can still be charged with a DUI crime. According to Georgia DUI law, you may be arrested and booked for being under the influence of alcohol or drugs to such an extent that it is "less safe" for you to drive. It can occur, therefore, that you blood alcohol content ( BAC) was under the legal limit and you were still charged. Many drivers in Forsyth County are unaware of this law and that this type of DUI offense does not require a breath or blood test or have a number attached to it (such as .08%), in order for an arrest to be made.
